Sales act changes on horizon

Dealers are being reminded that a number of changes to the Motor Vehicle Sales Act 2003 will come into force from October 22.
The Motor Vehicle Traders Register (MVTR) says all online application forms for registration, including renewal applications, will be updated from that date with the amendments.
The changes mean applicants will be asked to provide additional information, including a certified copy of an identity document such as a passport or driver licence. For companies, this applies to each role holder listed in the application.
An email address will need to be provided that can be used for the service of documents and this address will also be published on the MVTR.
Other alterations include that a rural address can be listed as a physical address for the service of documents and applicants renewing their registration will need to provide an NZTA customer number.
The MVTR advises that anyone with a draft application in progress should complete and submit it no later than 5pm on Tuesday, October 21.
Other changes being made to the act will result in the timeframe for notifying the registrar a new person is concerned in the management of a registered company being reduced from 30 working days to 20.
They will also remove the need for a role holder to sign the application form.
“You still need to include a signed statutory declaration,” adds the MVTR. “However, role holders will no longer need to be logged into the portal to also complete the required checkboxes.”
It explains further tweaks to the regulations have been designed to streamline the application process.
For companies, this means first-time or reapply applications must include a statutory declaration from one role holder that also confirms the application is true and correct and no role holder is a disqualified person.
A standardised statement will also be included in the declaration form for ease and renewal applications require a certificate of confirmation signed by one role holder listed in the application.
Both forms will be downloadable and editable from the MVTR portal and can be uploaded once completed.
